Terms of Service

These terms govern your use of DigDispatch, operated by DigDispatch (“DigDispatch,” “we,” “us”). By creating an account or using the service, you agree to them on behalf of yourself and the company you use DigDispatch for. If you don't agree, don't use DigDispatch.

1. What DigDispatch is

DigDispatch is a software platform. Contractors (“Contractors”) post vacuum-excavation and related jobs; vacuum truck companies (“Vac Companies”) see eligible jobs, schedule, and claim or request them. DigDispatch is not a party to any agreement between a Contractor and a Vac Company, does not employ or supervise either, does not perform or inspect any work, and does not guarantee that any job will be filled, performed, or paid for.

2. Accounts

  • You must be at least 18 and authorized to act for your company.
  • Give accurate information and keep it current, including your mobile number and, for Vac Companies, your insurance and USDOT details.
  • You're responsible for everything done under your account and your company's account. Keep your login secure and tell us about any unauthorized use.
  • Company owners and admins control who is on their team and what they can do.

3. Contractor responsibilities

  • Post accurate job information, including locations, pins, site hours, scope, site conditions and site contact.
  • You remain responsible for utility locates (811 / one-call), permits, site access, traffic control, and site safety as required by law and your contracts. Pins and notes on DigDispatch do not replace a locate ticket or field marks.
  • Review and approve or dispute work tickets promptly, and pay Vac Companies under the terms you agree with them.

4. Vac Company responsibilities

  • Hold all licenses, registrations, permits and insurance required for your work, and keep the details you provide current.
  • Claim only jobs you can staff with suitable equipment in the hours you pick, and give jobs back promptly if you can't.
  • Perform work safely, follow excavation and disposal rules, and respect locate marks and site instructions.
  • Submit accurate work tickets and invoices.

5. Agreements and payments between users

When a Vac Company claims a job, or a Contractor accepts a request, that is an arrangement between those two companies. Pricing, purchase orders, payment terms, invoicing, disputes, warranties and liability for the work are between them. Invoice and payment status shown in DigDispatch is recorded by users for convenience; DigDispatch does not process, hold, or guarantee those payments.

6. DigDispatch fees

Contractors pay DigDispatch for their plan (for example, a fee per filled job or a monthly subscription) as shown at sign-up or in Billing. Unless agreed otherwise in writing, fees are billed in advance for subscriptions and monthly in arrears for per-job plans, through Stripe, by card or by invoice on the terms shown on the invoice. Fees are non-refundable except where required by law. We may change prices with at least 30 days' notice; changes apply from your next billing period. Accounts with unpaid balances may be limited or suspended. Vac Companies currently use DigDispatch free of charge.

7. Text messages and email

By adding a mobile number and leaving text alerts on, you agree to receive automated job-related texts from DigDispatch. Message frequency varies. Message and data rates may apply. Reply STOP to opt out, START to resume, HELP for help. Details are in the Privacy Policy.

8. Acceptable use

Don't:

  • post false, misleading or fake jobs, claims, tickets, invoices or ratings;
  • use contact details from DigDispatch to spam or market to other users unrelated to their jobs;
  • access accounts or data that aren't yours, scrape the service, or interfere with its operation or security;
  • use DigDispatch for anything illegal.

9. Ratings and content

You own the content you add, such as job details, messages and tickets. You give DigDispatch a license to host, display and process it to run the service, including showing it to the other company on a job. Ratings must be honest and based on real jobs. We may remove content that breaks these terms.

10. Suspension and termination

You can stop using DigDispatch at any time. We may suspend or close accounts that break these terms, create risk for other users, or don't pay. Sections that by their nature should survive (including 5, 6 for amounts owed, and 11–13) survive termination.

11. Disclaimers

DigDispatch is provided “as is” and “as available.” We don't warrant that it will be uninterrupted or error-free, that alerts or texts will be delivered on time, that map data, geocoding or distances are exact, or that any user is qualified, insured, or will perform or pay. To the fullest extent allowed by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the fullest extent allowed by law, DigDispatch will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, delays, property damage, utility strikes, injury, or disputes between users arising from work arranged through the service. Our total liability for any claim relating to DigDispatch is limited to the fees you paid us in the 12 months before the claim.

13. Indemnity

You'll defend and indemnify DigDispatch against claims arising from your company's jobs, work, site, content, or breach of these terms, including claims between you and another user.

14. Changes to these terms

We may update these terms. We'll post the new version here with a new effective date and, for significant changes, notify account owners. Continuing to use DigDispatch after changes take effect means you accept them.

15. Governing law

These terms are governed by the laws of the state in which DigDispatch's operating company is organized, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located there.
